WAIVER / CODE OF CONDUCT

The undersigned player (“Player”) and his parent(s) or legal guardian(s) (“Parent”) agree to the following:

WAIVER – AFFIDAVIT OF INDEMNITY

Parent hereby waives any and all claims and causes of action for damages for personal injuries or otherwise to the player which may arise by virtue of acts or omissions to act, negligent or otherwise, on the part of SCOTS Baseball Club, and all of their respective directors, officers, employees, managers, coaches, agents, umpires, scorers, and sponsors (all indemnitees herein), and agrees to hold said indemnitees harmless and indemnify them against all claims. This Affidavit of Indemnity extends to any claim, suit, or action brought by the Player or on his behalf, or by or for Parent’s benefit, or by or for the benefit of any other person or entity, it being Parent’s specific intent to fully indemnify and hold harmless the indemnitees listed herein without limitation of any kind as to party, nature of claim, amount of claim or time interval involved. Parent understands and agrees that SCOTS BASEBALL CLUB directors, officers, managers, coaches, employees and sponsors have no obligation to pay, or furnish insurance to pay, any medical, dental, or hospital bills that may be incurred by Player or any other SCOTS BASEBALL CLUB player. Parent hereby accepts sole responsibility for any such bills that may arise from injury to the Player. If the Player is injured, Parent agrees to hold harmless and authorize anyone available to provide him first aid or emergency treatment that may be deemed appropriate at the time. Parent further waives any and all rights, claims, actions, causes of actions or suits that Parent may have or may hereafter have as a result of any personal injury or property damage Player or Parent might incur while in attendance at any evaluation, tryout, practice, scrimmage, game or other activity of SCOTS BASEBALL CLUB. This Affidavit of Indemnity extends to any claim, suit or action brought by Player or Parent for or on Player’s or Parent’s behalf, or for or on behalf of any other person or entity, it being Parent’s specific intent to fully indemnify and hold harmless the indemnitees listed herein without limitation of any kind to party, nature of claim, amount of claim or time interval involved. Parent fully understands the importance and significance of signing this Affidavit of Indemnity and has secured the advice of an attorney if Parent deemed it necessary to Parent’s full understanding. Parent further understands that SCOTS BASEBALL CLUB has no obligation to accept the Player as a participant, and Parent deems it a material benefit and sufficient consideration for the giving of this Affidavit of Indemnity.

CODE OF CONDUCT

The Player and his Parent are a direct reflection of the team and the SCOTS BASEBALL CLUB. Both the Player and his Parent are expected to follow the SCOTS BASEBALL CLUB Code of Conduct, including but not limited to the following:

• Treat coaches, parents, teammates and opponents with respect. Be supportive and encouraging.
• Never argue with or criticize coaches, teammates, opponents or umpires.
• Avoid inappropriate behavior, including the use of profanity or other inappropriate language, during practices, games and other SCOTS BASEBALL CLUB activities.
• Treat personal and team property with respect at all times. Never throw a helmet, bat or other equipment.
• Wear the appropriate uniform/equipment with jersey tucked in and wear hat forward at all times.
• Be on time for all practices and games.
• Inform coach as soon as possible (at least 24 hrs.) if missing a game or practice.
• Attempt to win through skill, effort, practice and tactics; but, play fairly at all times.
• Take victory modestly, defeat graciously and exhibit good sportsmanship at all times.
• Play hard on every play and in every practice and game.
• Run on/off the field every inning of every game and practice.
• Run full speed on the base paths. Always pick up your base coach after every pitch. Never miss any sign.
• Follow the directions of your coach.
• Go directly to the coach with any questions or concerns.
• Respect the facilities. No seeds/gum/food/tobacco products at the Indoor Facility or HPISD turf fields.
• Remember that the game is for the players, not for the parents. As such, parents are required to remain outside of the dugout and off the field at all times and will refrain from speaking to players until the game is over. Cheer for your player, but do not coach from the stands.

The SCOTS BASEBALL CLUB reserves the right to dismiss players/parents from the team for conduct detrimental to the team or the club.

PARTICIPATION

The purpose of the SCOTS BASEBALL CLUB is to increase the baseball knowledge and skills of its team members through instruction, practice and competitive game participation. To that end, the SCOTS BASEBALL CLUB commits to:

• Teach and model good sportsmanship.
• Treat all players with respect, regardless of skill level or experience.
• Provide knowledge of proper skills and methods of instruction to all team members appropriate for their position(s), and improve the Player's understanding of the game.
• Communicate on a regular basis with players and parents.
• To provide all players with playing time, recognizing that coaches will make the best use of players’ skills in game and tournament settings. This does not guarantee playing time in each game nor does it guarantee equal playing time. Player and
• Parent acknowledge that SCOTS BASEBALL CLUB is a club organization and that no specific amount of playing time is guaranteed for Player or any other player on any team.

DISPUTES

In the event of any disagreement, dispute or dissatisfaction regarding any aspect of the operation of the SCOTS Baseball Club, any of its teams, player participation, coaching instruction, etc., Parent agrees to discuss the situation with the team’s Coach at an appropriate time. Before, after or during games and during practice is not considered appropriate. We request that 24 hours pass before issues are brought up to the Coach, so each party can prepare and discuss the situation to the best possible resolution. If appropriate, and only after discussion with the team Coach, the situation may be raised with a member of the SCOTS Board of Directors or designee. SCOTS Baseball Club is the sole authority for any and all decisions regarding the coaching staff, player participation and all other operations of the SCOTS Baseball Club.

CONCUSSION PROTOCOL

Parent acknowledges that SCOTS Baseball Club has a concussion protocol posted on its website and Parent understands the protocol’s importance to the Player. If the Player is diagnosed with a concussion during a SCOTS BASEBALL CLUB activity or during ANY OTHER ACTIVITY (including those outside SCOTS Baseball), or if the Player has a prior head injury, Parent will inform Player’s Coach of such diagnosis prior to the start of the season and/or before Player returns to play. If Player is removed from practice, play or competition due to a head injury or suspected concussion, Player may not return to Club activities until the Player has been evaluated by a currently licensed medical professional trained in the evaluation and management of concussions and has received written clearance from that licensed medical professional to return to play. Parent agrees to review the CDC’s “Heads Up: Concussion in Youth Sports, A Fact Sheet for Parents” available from the CDC’s website. (https://www.cdc.gov/headsup/youthsports/parents.html)  Parent further agrees to share with Player the CDC’s “Heads Up: Concussion in Youth Sports, A Fact Sheet for Players” document and corresponding training video from the CDC’s website. Parent is encouraged to obtain a baseline test for Player.
